Under the Patient Protection and Affordable Care Act, many employers must report the aggregate cost of applicable employer-sponsored group health plan coverage on each employee's Form W-2, Wage and Tax Statement, for 2012 and beyond. On Jan. 3, 2012, the Internal Revenue Service (IRS) issued Notice 2012-09, which provides additional clarification regarding the W-2 provision that has created uncertainty for employers, including what types of plans are subject to the provision, whether all employers must comply and the method for determining the cost of health coverage. COBRA Update: ARRA Amendments

Few pieces of legislation have had such an immediate impact on the employee benefits world as the recent passage of the American Recovery and Reinvestment Act of 2009 (ARRA). The new law provides a 65% COBRA subsidy payment for employees whose employment is involuntarily terminated between September 1, 2008 and December 31, 2009. Employers will have a new notification requirement informing eligible beneficiaries of the availability and terms of the subsidy.
